These Terms of Service ("Terms") constitute a legally binding agreement between you ("you", "your", "User") and Own The Reply ("we", "us", "our", "Company") governing your access to and use of the Own The Reply website at ownthereply.com and its associated web application (collectively, the "Service").
By creating an account, clicking "I agree", or otherwise accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated into these Terms by reference.
If you are using the Service on behalf of a business or other legal entity, you represent that you have the authority to bind that entity to these Terms.

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time with reasonable notice to active subscribers.
You must be at least 18 years of age to use Own The Reply. By creating an account you represent and warrant that you are 18 or older and have the legal capacity to enter into a binding agreement.
To access the Service you must create an account by providing a valid email address and password. You agree to provide accurate, current, and complete information and to update it as necessary to keep it accurate.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at hello@ownthereply.com if you become aware of any unauthorised use of your account. We are not liable for any loss or damage resulting from your failure to maintain the security of your account.
Each account is for use by a single individual or business entity. You may not share your account credentials with others. Agency plan subscribers may manage multiple client locations within a single account as permitted by their plan.
Own The Reply offers the following subscription plans:
Plan features and pricing are subject to change. We will provide at least 30 days' notice to existing subscribers before any price increase takes effect.
Subscriptions are billed monthly in advance. Payment is processed by our third-party payment processor, Stripe. By providing your payment details, you authorise us to charge your payment method on a recurring monthly basis until you cancel.
Your monthly reply generation limit resets on the first day of each calendar month. Unused generations do not roll over to the following month. If you reach your monthly limit, you may upgrade to a higher plan or wait until your limit resets.
You may upgrade or downgrade your plan at any time from your account settings. Upgrades take effect immediately. Downgrades take effect at the start of your next billing period.
You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period — you retain full access to the Service until that date. We do not provide pro-rated refunds for partial months. If you cancel within the first 7 days of your paid subscription (after any free trial), you may contact us at hello@ownthereply.com to request a full refund at our discretion.
If your payment fails, we will notify you by email and attempt to retry the charge. If payment remains unsuccessful after reasonable retry attempts, your account may be downgraded to a read-only state until payment is resolved.
New users may access Own The Reply on a 7-day free trial without providing payment details. The free trial provides access to Starter plan features with a limit of 30 AI reply generations.
At the end of the free trial period, continued use of the Service requires selecting a paid subscription plan. If you do not add a payment method, your account will be placed in read-only mode — you can view your dashboard but cannot generate new replies.
We reserve the right to modify or discontinue free trial offers at any time. Free trials are available to new users only and may not be combined with other promotions.
You agree to use Own The Reply only for lawful purposes and in accordance with these Terms. You agree not to:
We reserve the right to suspend or terminate accounts that violate these acceptable use requirements, with or without prior notice depending on the severity of the violation.
Own The Reply integrates with Google Business Profile via Google's official APIs. Your use of the Google integration is also subject to Google's Terms of Service and Google Business Profile policies. You are responsible for ensuring your use of Google Business Profile through our Service complies with Google's policies.
We are not affiliated with, endorsed by, or sponsored by Google. "Google" and "Google Business Profile" are trademarks of Google LLC.
We also use Anthropic's Claude API to generate reply content and Stripe for payment processing. These third-party services are subject to their own terms of service, which you should review independently.
We are not responsible for the availability, accuracy, or performance of any third-party services. Outages or changes to Google's APIs, Anthropic's API, or Stripe's platform may temporarily affect the availability of features within Own The Reply.
Own The Reply uses artificial intelligence to generate draft review responses. You acknowledge and agree that:
You retain ownership of your business information, the Google reviews associated with your account, and any content you create or post through the Service.
By using the Service, you grant us a limited, non-exclusive, royalty-free licence to access, process, and display your content solely to the extent necessary to provide the Service — specifically, to fetch your reviews, generate AI reply drafts, and post approved replies on your behalf.
We do not claim ownership of your content. We do not use your content, your review data, or your generated replies to train AI models.
You are responsible for the accuracy of the business information you provide during onboarding. Inaccurate information will result in AI-generated replies that do not correctly represent your business.
Own The Reply, including its name, logo, design, software, code, and all content created by us (excluding your content) is owned by Own The Reply and protected by applicable intellectual property laws.
These Terms do not grant you any right to use our name, logo, trademarks, or other brand elements except as expressly permitted in writing. Agency plan subscribers may use white-label features under the terms of their plan, but may not represent themselves as Own The Reply or imply endorsement by us.
If you provide feedback, suggestions, or ideas about the Service, you grant us the right to use that feedback for any purpose without compensation or attribution.
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free from viruses or other harmful components. We do not warrant that the AI-generated content will be accurate, complete, or suitable for your particular purpose.
To the fullest extent permitted by applicable law, Own The Reply and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, loss of goodwill, or damage to reputation, arising out of or relating to your use of or inability to use the Service.
Our total liability to you for any claims arising out of or relating to these Terms or the Service shall not exceed the total amount you paid to us in the 12 months preceding the claim.
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for consequential damages, so some of the above limitations may not apply to you.
We make no representations or warranties regarding the impact of using Own The Reply on your Google search ranking, review rating, revenue, or any other business metric. Any statistics or case studies we reference are illustrative and results may vary.
You agree to indemnify, defend, and hold harmless Own The Reply and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with:
You may close your account at any time from your account settings. Upon closure, your access to the Service will be revoked at the end of your current billing period. Your data will be retained for 30 days after account closure and then permanently deleted, as described in our Privacy Policy.
We may suspend or terminate your account immediately, with or without notice, if:
Upon termination by us for cause, any outstanding subscription fees become immediately due. We will provide a pro-rated refund for any prepaid subscription period remaining only where termination is not due to your breach.
Upon termination for any reason, your right to access and use the Service ceases immediately. Sections of these Terms that by their nature should survive termination will survive, including Sections 9, 10, 11, 12, and 15.
We may update these Terms from time to time. When we make material changes, we will notify you by email at least 14 days before the changes take effect and update the "Last updated" date at the top of this page.
Your continued use of the Service after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree with the changes, you must stop using the Service and may cancel your subscription before the effective date.
These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
Any dispute arising out of or relating to these Terms or the Service that cannot be resolved informally shall be resolved by binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Delaware. Judgment on the arbitration award may be entered in any court of competent jurisdiction.
Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.
Class action waiver: You agree to resolve disputes with us individually and not as part of a class action or representative proceeding.
